These Terms & Conditions (“Terms”) govern your access to and use of the website www.evolve.tatamotors.com (“Website”) operated by Tata Passenger Electric Mobility Limited (hereinafter referred to as “TPEM”), and by accessing, browsing, using the Website, you agree to be bound by these Terms. Do not continue to use the Website, if you do not agree to accept all the Terms stated herein.

The information on the Website has been included in good faith and is for informational purposes only. It should not be relied upon for any specific purpose and no representation or warranty is given as regards to its accuracy or completeness or for making any decision.

To use certain features of this Website, you are required to login as a member (“Member”), the details of which are provided in the registration form available on the Website. Membership to the programme is open to all TATA.ev owners subject to the criteria specified from time to time by TPEM.

If you apply for any product or service detailed on this Website, these Terms should be read in conjunction with and in addition to any other terms and conditions which relate to any such specific product or service and, in the event of any contradiction between these Terms and the specific terms and conditions relating to such product or service, the latter shall prevail.

TPEM hereby reserves the right to:

• change or remove (temporarily or permanently) the Website or any part of it without notice and you confirm that TPEM shall not be liable to you for any such change or removal;
• change, remove or discontinue any service, promotion, discounts, etc. as advertised on the Website at any time without notice and you confirm that TPEM shall not be liable to you for any such change or removal;
• change these Terms at any time without any notice or assigning any reason therefore, and your continued use of the Website following any changes shall be deemed to be your acceptance of such change.

This Website is for personal and non-commercial use only.

The Website and all information, names, images, pictures, logos, icons, and materials displayed thereon, whether relating to TPEM and/or its corporate parents, subsidiaries, affiliates, etc., are provided on an ‘as is’ basis, without any representation or endorsement of any kind being made. TPEM expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including without limitation, any implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. To the maximum extent permitted by applicable law, all such terms and warranties are hereby expressly exclude.

In the event, any provision of these Terms is declared by any judicial or other competent authority to be invalid, void, voidable, illegal or otherwise unenforceable or, if any indication of a similar nature is received, TPEM reserves the right to amend such provision solely to the extent necessary to give effect to the original intent, and any such amended provision shall be binding upon you. The remaining provisions of these Terms shall remain continue to remain valid, enforceable, and in full force and effect.

THIRD PARTY LINKS DISCLAIMER

The Website, inclusive of all material contained therein, may include links to third-party websites that are controlled and maintained by others. Any link to such third-party websites is not an endorsement of such websites or content therein and you acknowledge and agree that TPEM is not responsible for content, accuracy or availability of any such websites. Use of such third-party websites shall be at your own risk.

OWNERSHIP OF CONTENT AND COPYRIGHT

• All content available on the Website, including but not limited to text, images, logos, icons, graphics, audio/video clips, software (whether developed by TPEM or employed by it to operate the Website), design, layout, compilations, user interfaces, and all other materials (collectively, referred to as “Content”) shall belong to TPEM. All Intellectual Property Rights subsisting in this Website and Content is the exclusive property of TPEM or its licensors.
• The Content is protected under applicable copyright, trademark, and intellectual property laws of India. You or any third party acting on your behalf, shall not copy, reproduce, distribute, transmit or publish any Content, on any other website, social media platform, blog or computer network, or in any non-electronic format without prior written consent of TPEM. Any unauthorised use of the Content shall constitute a material breach of these Terms and may result in civil and criminal liability under applicable law.
• All trademarks, service marks, logos, labels, brand identifiers and trade names displayed on the Website (collectively, “Marks”) are the exclusive property of TPEM or its licensors. No right, licence, or permission is granted to you, whether expressly or by implication, to use any of the Marks. You shall not use, imitate, or reproduce any Marks in any manner without prior written authorization from TPEM. TPEM reserves all the rights to invoke all and any civil and criminal remedies available to it under the law in the event of use, misuse, imitation, or infringement of its Marks.
• For the purposes of these Terms, “Intellectual Property Rights” includes the following (wherever and whenever arising and for the full term of each of them): any patent, trademark, trade name, service mark, service name, design, design right, copyright, database right, moral rights, know how, trade secret and other confidential information, rights in the nature of any of these items in any country, rights in the nature of unfair competition rights and rights to sue for passing off and other similar intellectual and commercial right (in each case whether or not registered or registrable) and registrations of and applications to register any of them. TPEM retains and reserves all rights in such Intellectual Property Rights.

WEBSITE FUNCTIONALITY

• The Website, products and services therein are provided on an “as is” and “as available” basis without any representation or endorsement of any kind being made and without any warranty of any kind whether express or implied, including but not limited to the warranties as specified above.
• TPEM makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.

JURISDICTION AND APPLICABLE LAW

• In the event of any dispute about or involving these Terms and/or the Website between you and TPEM, the dispute shall be governed by the laws of India and the courts of Mumbai alone, to the exclusion of any other, shall have the jurisdiction to try and entertain such disputes.
• With respect to the global nature of the Internet, you shall comply with all local laws/rules regarding user conduct on the Internet and acceptable content.

INDEMNIFICATION

You agree to indemnify, defend and hold harmless, TPEM and its employees and agents from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against TPEM arising out of or relating to your misuse of the Website or Content or any breach by you of these Terms or infringement of third party rights or any other liabilities arising out of your use of this Website.

DATA PROTECTION AND PRIVACY

• TPEM shall through this Website collect, process, store, share, and protect personal data, including without limitation your name and e-mail address, in accordance with the privacy laws including the Digital Personal Data Protection Act, 2023 and its rules.
• By accessing or using the Website, you consent to TPEM’s processing of your personal data as described in the Privacy Policy, which shall form an integral part of these Terms.
• By accessing or using the Website, you hereby provide your free, specific, informed, unconditional and unambiguous consent, through a clear affirmative action, for TMPV to collect and process your personal data for the purposes, including enabling Website functionality, verifying eligibility, administering membership, and providing SOUL programme related benefits.
• You have the right to withdraw consent, request corrections or modifications, or request erasure of your personal data in accordance with applicable laws, subject to legal requirements.
• No ideas, material, computer code, information or other communication you submit or post to the Website will be considered confidential or proprietary. All such material becomes the exclusive property of TPEM, which is entitled to use such material for any purpose without restriction or compensation.

LIABILITY

• In no event will TPEM or any of its corporate parents, subsidiaries, affiliates etc. be liable (whether in contract or tort (including negligence or breach of statutory duty) or otherwise) for any losses sustained and arising out of or in connection with the use of this Website including, without limitation, loss of profits, loss of data or loss of goodwill (in all these cases whether direct or indirect) nor any indirect, economic, consequential or special loss.
• To the maximum extent that such is permitted by law, TPEM including its affiliated companies, its directors, managers and employees – hereby are excluded from all liability for any damage whatsoever, including any direct, indirect, incidental, consequential, remote, special, punitive, exemplary damage or loss of profits or loss of goodwill or loss of business opportunity, caused, whether directly and/or indirectly, in any way by and/or resulting from your use of the website or your reliance on any information, content, scheme or Offer available on the Website, including - but not limited to damages caused by and/or resulting in any way from:
  • actions performed by you that could have been prompted by the information published on the Website.
  • the impossibility of or interruptions faced while using the Website; and
  • The fact that certain information on the Website is incorrect, incomplete or not up to date.
  The limitations mentioned in the preceding paragraph shall not apply if and insofar as the damage, death or personal or injury is the result of intentional acts or omissions or gross negligence by TPEM.

PROMOTIONAL CONTENT

By accepting these Terms, you consent to TPEM to send promotional content, created solely to market or highlight products, services, or offers featured on this Website. All information is provided in good faith. Offers, prices, and details are subject to change without prior notice. The Website is not responsible for any loss, damage, or misunderstanding arising from promotional content or decisions made based on it.

DOWNLOADED SOFTWARE

If you download any software from this Website, the software and all files, images and data relating to the software will be licensed to you by TPEM. You, by any means, do not own the downloaded software, and TPEM does not transfer ownership of the software to you. TPEM retains full ownership of and title to the downloaded software and all Intellectual Property Rights related to the software. You may not, either directly or through any third party, redistribute, sell, decompile, reverse engineer, disassemble, or otherwise reduce the software to a human-perceivable form.

ENGAGEMENT ACTIVITIES AND ADDITIONAL BENEFITS

• TPEM may, at its sole and absolute discretion, from time to time, organise or facilitate engagement activities or extend additional benefits exclusively for the Members. Such activities or benefits may include, without limitation, breakfast drives, curated experiences, giveaways, early or priority access to events, community meetups, or any other similar engagement initiatives (“Engagement Activities”)
• Participation in any Engagement Activity shall be voluntary and subject to (i) availability; (ii) any specific terms, conditions, eligibility criteria, or registration requirements prescribed by TPEM for such activity; and (iii) TPEM’s right to modify, withdraw, or cancel any Engagement Activity at any time without prior notice and without assigning any reason.
• PEM shall not guarantee the continuity, frequency, or availability of any Engagement Activities, and nothing herein shall be construed as creating any obligation on TPEM to offer or continue offering such Engagement Activities. TPEM shall not be liable for any loss, damage, delay, or inconvenience arising out of or relating to any change, cancellation, or unavailability of any Engagement Activity.

MEMBERSHIP

• Membership to EVOLVE Concierge Program is open to all EVOLVE members and the criteria will be specified from time to time by TPEM. TPEM reserves the right to extend or withdraw invitations for membership without assigning any reasons. EVOLVE Concierge program will be an on-going loyalty program for customers of TATA.ev owners only. The membership to the EVOLVE Concierge program shall be valid till the customer is a registered owner of a TATA.ev vehicle.
• TPEM reserves the right to alter the program at any point of time, and the decision of TPEM shall be final and binding in all matters pertaining to the program. TPEM reserves the right to decline membership to any customer it may deem appropriate.
• You are prohibited from posting or transmitting to or from the Website any unlawful, infringing, threatening, libellous, defamatory, obscene or pornographic material or any other material that would violate any law and TPEM reserves the right to delete/remove such distasteful material without giving any notice. TPEM reserves the right to block such Member from entering the website permanently. Views expressed or comments offered by the Members shall be personal in nature of the Members and TPEM shall not have any responsibility whatsoever in this regard.

EVOLVE CONCIERGE PROGRAM

• Definitions
  • "Owner" shall mean a TATA.ev owner to whom the EVOLVE Concierge Program benefits have been extended.
  • “Participating Merchant(s)”shall mean those third-party entities who have agreed to offer special privileges or discounts to the Owners associated with the EVOLVE Concierge Program.
  • "Offer" shall mean special privileges, benefits and/or discounts extended by various Participating Merchant partners listed hereunder.

• General Undertaking by Owner for all Offers
  • The Owner understands that each individual Offer extended under the EVOLVE Concierge Program is subject to the general terms and conditions for the Offers respectively provided, and the Owner agrees to remain bound by the same.
  • The Owner further understands and accepts that the Terms listed herein are in addition to the Terms of Use of the Website and undertakes to remain bound by the same.
  • TPEM, being the manufacturer of the TATA.ev vehicles, acts solely as a facilitator for enabling Owners to avail various Offers provided through the EVOLVE Concierge program in collaboration with Participating Merchants.
• Terms and Conditions for Offers released through EVOLVE Concierge Program (for Hotel, Travel & Vacation Planning, Curated Experiences & Gifting)
  • The Owner shall contact the EVOLVE Concierge (details provided herein) to avail of the concierge assistance and associated Offers and benefits. Unless otherwise stated by the respective Participating Merchant, the Offers and benefits as mentioned herein above cannot be redeemed in combination with any other discounts or promotions or vouchers or special events and shall not be valid on the blackout dates i.e. – 14th February, 24th December, 25th December and 31st December and/or any other dates notified by the respective Participating Merchant.
  • All Offers have specific validity periods. Owners are advised to contact the EVOLVE Concierge to obtain details regarding the applicable Offers and their validity dates. All Offers and/or benefits offered by Participating Merchant are subject to change/withdrawal without prior notice. The Offer shall have no monetary value, shall not be transferable, and shall not be sold or resold, or redeemed for cash. No two Offers may be clubbed together. Any discounts, if applicable, shall be valid on only on the net amount (excluding taxes and any other charges). All applicable taxes shall be paid by the Owner.
  • Terms & Conditions prescribed by each Participating Merchant for its respective Offers shall apply. Owners are required to check with the EVOLVE Concierge regarding such applicable terms. Nothing contained herein shall be construed as TPEM providing or guaranteeing the products and/or services being offered by any Participating Merchant. All products and services are sold and provided solely by Participating Merchants, in accordance with the terms and conditions as determined by them. TPEM accepts no liability whatsoever in connection with such products and/or services. All queries, complaints and issues related to the Offer must be exclusively directed to EVOLVE Concierge.
  • The EVOLVE Concierge Offers and related terms and conditions are specific to India and governed by laws of India alone.
  • Owners shall be required to send in their request for booking at least 72 hours before the intended travel date. Concierge representatives will provide agent details on the day of travel, 1 to 2 hours before departure. In case of urgent requests, additional charges by way of express charges shall be applicable.
  • EVOLVE Concierge will obtain the required information from the Owner for availing mobility as a service, such as flight details, name, mobile no., etc.

By using this Website, you represent that you are of a legal capacity to assume, and hereby do assume, all and any risks related to the use of this Website and its Content, and your use of this Website constitutes your agreement with TPEM to be legally bound by, and to act in accordance with, these terms and conditions of use.

These Terms together with any documents expressly referred to in them, are the terms and conditions relating to the subject matter covered for the use of this Website.
